The Journal of Equipment Lease Financing (JELF) is one of the Foundation’s most popular offerings, as the publication addresses industry trends in accounting, legal, tax, legislative, and regulatory issues as well as hot new markets. An article in the most recent issue of the Journal addresses one such market: business aircraft. The article, titled Business Aircraft Financing: it’s like any other equipment financing except more complicated, by Edward K. Gross, Rhonda Maggiacomo, and Adam L. Schless, has received rave reviews. Phyllis Grossman, Managing Director of GE Capital Markets Group, and JELF editorial board member added, “This article is a ‘must read’ for those thinking about the business or in the business already. It is so well written and it addresses all the issues special to this business.” The business aircraft market is expected to grow in the coming years as air travel becomes more important due to market growth and globalization and more difficult due to increased airport security. Private air transportation is becoming an important tool for businesses whose suppliers, operations or customers are located in places most efficiently reached via air travel. The JELF article discusses business aircraft financings, from its unique regulatory and tax characteristics to operations, maintenance and perfection issues. “As someone who is just getting started in aircraft financing, it was very well researched. The article was a good starting point to understand what is involved in aircraft financing,” said Harry Kaplun, President of Frost Leasing. Also included in the article is a brief discussion of the Cape Town Convention. Kaplun continued, “Aircraft financing is getting more complicated with Cape Town. This article talked about it in a way that a non-attorney can understand. It really helped us understand all that is being discussed among attorneys, regulators and aircraft specialists. And, even though you may have those specialists, I don’t know if anyone has enough experience as to how Cape Town works. This gives you a good start.” Interested parties may download the business aircraft article from the Foundation Web site store at http://www.leasefoundation.org/store/. The Fall JELF will be available shortly; articles will be on avoiding class action lawsuits concerning lease insurance programs, new 8-K reporting requirements on leasing companies, a legal guide to leasing in Russia for foreign lessors, and more on the Cape Town Convention.
